Introduction

A manufacturer’s brand is a very valuable asset because it differentiates the manufacturer’s goods and services from those of its competitors, and as the public comes to expect certain characteristics from the manufacturer’s goods and services, the manufacturer begins to develop goodwill in its brand. The legal term for a brand – that name or symbol or other indicia that identifies the source of certain goods or services – is a “trademark” or “service mark.”
