HB 1049. Amends motor vehicle dealer statutes to permit ease of sale, delivery and other activities over the internet and at locations other than dealership. Introduced 1/11/21 and assigned to House Committee on Consumer Protection and Business; passed House and sent to Senate 1/27/21.
Prohibits the sale by motor vehicle dealers and salespersons of new motor vehicles that are solely powered by fossil fuels and designed for personal use beginning 1/1/2035. Introduced 1/25/21; referred to House Committee on Energy and Environmental Preservation 1/27/21.
SB21. Establishes a zero net vehicle growth policy in the state to ensure that the number of vehicles in the state does not exceed the vehicle threshold; prohibits the importation of a vehicle into the state unless the dealer or individual importing the vehicle demonstrates proof that an existing vehicle in the state was recycled, destroyed, or transported out of the state. Introduced 1/21/21; assigned to Senate Transportation Committee.
SB 101. Expands definition of “motor vehicle dealer” for purposes of warranty reimbursement provisions to include manufacturers of engines, axles and transmissions that are separately warranted. Introduced 1/26/21; assigned to Senate Commerce and Energy Committee; public hearing scheduled 2/2/21.
SB 208. Prohibits motor vehicle OEMs from regulating the price at which dealers list vehicles on their websites. Introduced 1/13/21; assigned to Senate Committee on Judicial Proceeedings.
HSB 86. Requires a motor vehicle franchisor to provide dealers with a list of time allowances for the performance of warranty services, which must be reasonable and adequate for the services to be performed. Introduced 1/20/21; passed House Committee on Transportation 1/26/21.
Makes numerous, significant changes to the motor vehicle dealer law, including: Expands definition of motor vehicle dealer to including leasing; adds express factory store prohibition; permits revocation of a dealer license for failure to have properly trained service technicians; adds a full line make requirement; prohibits unreasonable performance measures; prohibits refusal to reimburse a dealer for providing loaner vehicles during warranty service; establishes required warranty reimbursement rates for dealers; adds required reimbursement provisions for recall work; adds prohibitions relating to used vehicle sales and allocation policies; limits required facilities upgrades by dealers; prohibits sanctions for sales of vehicles for export unless dealer had actual knowledge of intention to export. SB 1850. Permits additional or relocated motor vehicle dealers to be located within six or ten miles (depending on county population) of one another when separated by the Hudson River.
SB 2833. Establishes required warranty reimbursement rates for motor vehicle dealers and establishes procedure for determining rates. Introduced 1/18/21; assigned to Senate Committee on Finance.
SB 264. Establishes required warranty reimbursement rates for power equipment dealers. Introduced 1/21/21; assigned to Joint Committee on General Law; public hearing scheduled.
