A.     Extraterritoriality

1.       Morley-Murphy Co. v. Zenith Electronics Corp., 142 F.3d 373 (7th Cir. 1998)

a.       Dealer with a multi-state territory including Wisconsin sought protection under the WFDL from the supplier’s termination of the dealership.

b.       Seventh Circuit held that under the WFDL, a plaintiff with a multi-state territory could not recover damages attributable to the termination outside Wisconsin because:

i.            the WFDL was not intended to apply to those portions of a dealer’s territory outside of the state and

ii.                  If it was, that would raise Commerce Clause questions as to the constitutional viability of the statute.
