Coming to a Statute Near You: Motor Vehicle Dealer Laws as a Predictor of Dealer Protection Statutes

I.        History of the MVDLs

A.      Enacted as early as 1930’s to protect auto dealers from perceived unfair treatment by manufacturers

B.      Strong lobbyist groups lead to ever-changing, and ever-expanding, MVDLs

C.       Heavily regulate what provisions may or may not be included in a contract

D.      Prohibit contractual waiver of a remedy or defense allowed by statute

E.       May apply more broadly than “traditional” motor vehicles (e.g. engines, axles and transmissions for heavy duty trucks; trailers; off-road vehicles; snowmobiles)
